Right of withdrawal (services and digital content) & withdrawal form

Consumers have a right of withdrawal in accordance with the following provisions, a consumer being any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession:

 

A. Withdrawal policy (services and digital content)

Right of withdrawal

 

You have the right to withdraw from this contract within fourteen days without giving any reason.

 

The withdrawal period is fourteen days from the day the contract is concluded.

 

To exercise your right of withdrawal, you must inform us (Mareike Peters, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Contact, Telefon: 0049 (0)176 dreißig siebzig 36 30, Email: contact ( at ) mydaychart.com]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

 

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in any event, you will not incur any fees as a result of this reimbursement.

If you requested that the provision of services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal in respect of this contract, compared with the full coverage of the contract.

 

Exclusion or early expiry of the right of withdrawal

For contracts for the provision of services, the right of withdrawal expires early where we have fully performed the service and only began performance after you gave your express consent and at the same time acknowledged that you would lose your right of withdrawal upon our complete performance of the contract.

 

For contracts for the supply of digital content, the right of withdrawal expires early where we have begun performance of the contract after you have expressly consented to us beginning performance before the end of the withdrawal period, you have acknowledged that by giving your consent you lose your right of withdrawal upon the commencement of performance, and we have provided you with a confirmation of the contract on a durable medium that reproduces the content of the contract, including the aforementioned conditions for the early expiry of the right of withdrawal.
