1. Scope and Provider
These Terms and Conditions (“Terms”) apply to all purchases of digital products offered on https://mydaychart.com (the “Website”) by mydaychart (the “Provider”, “we”, “us”). Customers are consumers within the meaning of Section 13 of the German Civil Code (BGB): natural persons purchasing for purposes predominantly outside their trade, business or profession. The version of these Terms in force at the time of the order applies to that order. The Website offers exclusively digital products: personalized Human Design Day Chart reports, delivered electronically as PDF documents. No physical delivery is made, and no user account is created.
2. Products and Conclusion of the Contract
We offer several product tiers of the Day Chart report, as described on the Website at the time of the order. Each report is generated automatically and individually from the details you enter in the order form (first name, date of birth, place of birth). The presentation of products on the Website is not a binding offer. By completing the checkout and payment process, you make a binding offer to purchase. The contract is concluded when your payment is successfully completed; you will receive a confirmation of the contract by email on a durable medium. Please check your entries carefully before ordering. Because the report is computed automatically from the data you provide, we cannot detect incorrect entries (for example a wrong date or place of birth). Reports generated from incorrect entries are still considered delivered as ordered.
3. Prices and Payment
All prices shown at checkout are total prices and include statutory value-added tax (VAT) where applicable. Payment is due in advance. Payment is made via our payment provider Stripe (Stripe Checkout). Accepted payment methods are card payments and instant payment methods as offered in the checkout. Payment methods that do not confirm payment immediately (such as bank transfers or other asynchronous methods) are not available and will be rejected by the checkout. Payments are processed by our payment provider Stripe; details on the data processing involved can be found in our Privacy Statement at https://mydaychart.com/privacy-policy/.
4. Delivery
The purchased report is delivered electronically as a PDF document by email to the email address you provide during the order. Delivery takes place typically within 1 hour, and at the latest within 24 hours, after successful payment. If you have not received the report within 24 hours, please check your spam folder first and then contact us at contact@mydaychart.com. We will resolve the issue and make sure you receive what you paid for. Please save the PDF file after receiving it. You are responsible for backing up the delivered file. Because order data is automatically deleted 30 days after delivery (see Section 9), we cannot guarantee that a report can be re-sent after that period.
5. Right of Withdrawal
As a consumer, you have a statutory right of withdrawal. Details, including the model withdrawal form, are set out in our withdrawal policy at https://mydaychart.com/withdrawal/. Please note: for contracts for the supply of digital content, the right of withdrawal expires early pursuant to Section 356(5) BGB when we have begun performance of the contract after you have expressly consented to performance beginning before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal upon commencement of performance. During checkout, you are asked to give exactly this consent and acknowledgement before you can place the order; the generation of your report begins immediately after payment. We confirm the contract, including your consent and acknowledgement, on a durable medium in the delivery email.
6. License and Intellectual Property
Upon full payment, you receive a personal, non-transferable right to use the purchased report for your personal, non-commercial use. The Website and all content contained therein, including the delivered PDF documents, texts, designs and graphics, are protected by copyright. Any reproduction, distribution, publication, sale or disclosure to third parties, in whole or in part, requires our express written consent. Statutory limitations of copyright (such as the right to make a private copy for personal use) remain unaffected.
7. Purpose of the Content
No Advice mydaychart content and products are intended to support personal development, inspiration and self-awareness. They do not constitute medical, psychological, therapeutic, legal or financial advice and are not a substitute for professional advice or medical treatment. Please do not make significant decisions solely on the basis of a report; if you have health concerns, consult a qualified professional.
8. Warranty and Liability
Your statutory rights regarding defects in digital products (Sections 327 et seq. BGB) apply. We are liable without limitation for damages resulting from injury to life, body or health, for damages caused by intent or gross negligence, in cases of fraudulent concealment of a defect, under a guarantee we have given, and under the German Product Liability Act (Produkthaftungsgesetz). In cases of slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment is a prerequisite for the proper performance of the contract and on whose fulfilment you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded. We do not guarantee that the Website will be available without interruption or error at all times; this does not affect your rights concerning the delivery of a product you have purchased.
9. Data Protection
We process your personal data (such as your name, email address, date and place of birth) exclusively to generate and deliver the purchased report and to process the order. Details, including the service providers involved, are set out in our Privacy Statement at https://mydaychart.com/privacy-policy/. Payments are processed by our payment provider Stripe; see the Privacy Statement for details. Completed orders are automatically deleted 30 days after delivery; orders that were started but not paid are deleted after 7 days. Records we are legally required to keep (such as invoice and payment records under German tax law) are retained for the statutory periods and do not include birth data.
10. Dispute Resolution
We are neither willing nor obliged to participate in dispute settlement proceedings before a consumer arbitration board (Section 36 of the German Act on Alternative Dispute Resolution in Consumer Matters, VSBG).
11. Governing Law and Final Provisions
These Terms and all contracts concluded under them are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another country, the mandatory consumer protection provisions of that country remain unaffected by this choice of law. Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
12. Changes to these Terms
We may revise these Terms for future orders at any time by publishing an updated version on the Website. For each order, the version of these Terms in force at the time of that order applies.
